1. Acceptance of Terms

By accessing or using cleanairmoldtest.com or any services provided by Clean Air Mold Testing (“we,” “us,” or “our”), you agree to these Terms of Service. If you do not agree, do not use this site or our services.

2. Services Description

Clean Air Mold Testing provides the following services in Los Angeles, Ventura, and Orange Counties:

  • Mold inspection
  • Mold testing (air sampling, surface swabs)
  • Smoke damage inspection
  • Smoke damage testing
  • Moisture testing and mapping
  • Infrared and thermal imaging
  • Post-remediation clearance testing

We are independent inspectors. We do not provide mold remediation services and have no financial affiliation with any remediation company. Our role is to identify and document conditions — not to remediate them.

3. Limitation of Liability

Mold inspection has real limits. By using our services, you acknowledge:

  • Visible conditions only: Findings are limited to conditions reasonably observable on the date of inspection using the agreed-upon methods.
  • Hidden conditions are not warranted: Mold, moisture, or damage behind walls, under floors, inside HVAC systems, or in any inaccessible area may exist but cannot be guaranteed to be detected.
  • Lab results are sample-specific: Lab results reflect only the samples physically collected. We cannot guarantee whole-property conditions based on sampled areas.
  • Conditions change: We are not responsible for conditions that develop, change, or are introduced after the inspection date.
  • Maximum liability: Our total liability for any claim arising from an inspection is limited to the inspection fee paid for that specific inspection. We disclaim any liability for consequential, incidental, special, or punitive damages.

4. Use of Reports

  • Reports are prepared for the named client only and are not transferable.
  • Reports may not be shared with third parties (other than the client’s own insurance adjuster, attorney, or real estate agent acting on their behalf) without written permission from Clean Air Mold Testing.
  • Reports may not be used in litigation, arbitration, or formal legal proceedings without prior written consent from Clean Air Mold Testing.
  • 90-day window for real estate transactions: For property sale or purchase decisions, reports should be considered current for 90 days from the inspection date. Beyond that window, conditions may have changed and a follow-up inspection is recommended.

5. Payment Terms

  • Payment: Payment is due upon completion of the inspection appointment, before delivery of the written report. We accept cash, Zelle, wire transfer, check, and debit cards.
  • Cancellation: Appointments must be cancelled or rescheduled at least 24 hours in advance to avoid a cancellation fee. Cancellations made with less than 24 hours notice are subject to a $75 cancellation fee to cover scheduled time and travel.
  • Refunds: All inspection services are non-refundable once the inspection has been performed. This includes cases where: no findings of concern were identified, the customer disagrees with findings, or the customer chooses not to use the report. Refunds may be considered at our sole discretion only in cases of documentable service error. Liability is limited as described in Section 3 (Limitation of Liability).

6. Lab Results Disclaimer

We use accredited third-party laboratories — currently BTLS (Biotesting Laboratory Services) and Eurofins — for sample analysis. Lab results are governed by each laboratory’s own terms, methods, accuracy statements, and chain-of-custody procedures. We are not responsible for laboratory errors, sample contamination during transit, or interpretation disagreements between laboratories. We will, however, advocate on your behalf if a lab result appears anomalous and resubmission is warranted.

7. Website Use

  • Permitted use: Browsing for information, contacting us to request services, downloading documents we provide to you.
  • Prohibited use: Automated scraping, bulk downloading, reverse-engineering our forms, attempting to access non-public areas, uploading malicious content, or using our site to harass others.
  • Intellectual property: All content on cleanairmoldtest.com — text, photos, reports, branding — is owned by Clean Air Mold Testing and may not be reproduced or redistributed without permission.

8. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or our services shall be resolved in Los Angeles County, California.

Mandatory mediation: Before initiating any litigation, both parties agree to attempt resolution through good-faith mediation with a mutually agreed-upon mediator in Los Angeles County. Litigation may only be initiated if mediation fails or one party refuses to participate within 30 days of written notice.

9. Modifications

We may update these Terms at any time. The Effective Date at the top of this page will reflect the latest version. Material changes will be communicated by posting the updated Terms on this page. Your continued use of our website or services after a change indicates your acceptance of the updated Terms.

11. Severability
